These Terms of Service (“Terms”) govern your access to and use of polysets.com (the “Website”) and any digital assets, downloads, content, and related services offered through it. The Website is operated by PolySets (“PolySets,” “we,” “us,” or “our”).
By accessing the Website, placing an order, or downloading an Asset, you agree to these Terms. If you do not agree, do not use the Website or purchase or download our products.
1. Eligibility and authority
You must be legally capable of entering into a binding agreement in your jurisdiction. If you use the Website on behalf of a company or organization, you confirm that you have authority to bind that organization to these Terms.
2. Digital products
PolySets sells and may offer free digital assets for game development and related creative work. Product pages describe the files, formats, asset counts, compatibility information, and development status included with each product.
Digital products are licensed, not sold. Purchased Assets are governed by the One-Time Purchase Licence Agreement, and Assets identified as free are governed by the Free Asset Usage Licence. If these Terms conflict with the applicable Licence regarding permitted use of an Asset, that Licence controls.
Collections marked “In development,” “Concept preview,” or similar are previews and are not represented as finished downloadable products unless the relevant product page expressly says otherwise.
3. Orders and payment
Prices, currency, taxes, and available payment methods are displayed at checkout. You agree to provide complete and accurate billing and contact information.
An order is complete only when payment has been successfully processed and the Website or payment provider confirms the transaction. We may cancel or refuse an order where payment is unsuccessful, suspected to be unauthorized or fraudulent, or where required by law.
Third-party payment providers process payment information under their own terms and privacy practices. PolySets does not control delays or service failures caused by those providers.
4. Digital delivery
Purchased Assets are delivered electronically using the download method shown at checkout or in the order confirmation. You are responsible for ensuring that your device, software, storage, and internet connection can receive and use the disclosed file formats.
If a download link does not work or delivered files materially differ from the product description, contact support@polysets.com with your order details.
5. Product information and compatibility
We aim to keep product descriptions, preview images, file formats, counts, and compatibility information accurate. Minor visual differences may occur because of rendering settings, engine versions, lighting, materials, or software configuration.
Before purchasing, review the product description and confirm that the stated formats and technical requirements work for your project. Unless expressly stated, a product is not guaranteed to support every engine, application, platform, or workflow.
6. Intellectual property
The Website, PolySets branding, product previews, text, graphics, and Assets are owned by or licensed to PolySets and are protected by intellectual-property laws.
No rights are granted except those expressly stated in these Terms or the applicable Licence Agreement. You may not copy, scrape, republish, redistribute, resell, or exploit Website content or Assets except as expressly permitted.
7. Acceptable use
You must not:
- interfere with the security, availability, or operation of the Website;
- attempt to access restricted systems or another person’s account or order;
- use automated systems to scrape, harvest, or download Website content without written permission;
- use the Website for unlawful, fraudulent, abusive, or rights-infringing activity;
- misrepresent your identity, authority, order information, or entitlement to an Asset; or
- bypass purchase, access, download, or licence controls.
We may restrict or terminate access where we reasonably believe these Terms, the Licence Agreement, or applicable law has been violated.
8. Refunds
Refund eligibility and the process for requesting a refund are described in our Refund Policy. Nothing in these Terms limits any non-waivable consumer rights that apply to you.
9. Third-party links and services
The Website may link to third-party websites, software, engines, asset-pack stores, or payment services. Those services are governed by their own terms. A link does not mean that PolySets controls or guarantees the third-party service.
10. Availability and changes
We may update, suspend, or discontinue Website features, product listings, prices, or free downloads. Changes do not retroactively alter the licence granted for an Asset already purchased and paid for, except where required by law or agreed in writing.
We do not guarantee that the Website will always be available, uninterrupted, secure, or error-free.
11. Disclaimers
To the maximum extent permitted by law, the Website and its content are provided “as is” and “as available.” Product-specific warranties, disclaimers, and limitations are set out in the Licence Agreement.
Nothing in these Terms excludes a warranty, right, or remedy that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by applicable law, PolySets will not be liable for indirect, incidental, special, consequential, or punitive losses arising from use of the Website or an inability to access it.
Nothing in these Terms limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer-protection law.
13. Changes to these Terms
We may update these Terms to reflect changes to the Website, our products, our business practices, or applicable law. The revised version will be posted on this page with an updated date. Changes apply prospectively unless applicable law requires otherwise.
14. Governing law and disputes
These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-laws principles. The parties should first make reasonable efforts to resolve a dispute through good-faith communication. Any mandatory consumer-protection rights and jurisdiction rules that apply to you remain unaffected.
